Commercial Human Spaceflight and Informed Consent
Airliners are certified and their passengers are told nothing about the process. Launch vehicles are not certified, and their occupants must be told so in writing before they agree to fly. That inversion is deliberate and statutory.

The rule in short
Federal law restrains the FAA from issuing regulations governing the design or operation of a launch vehicle to protect the health and safety of occupants, absent an event or a demonstrated risk that lifts the restraint. In its place the rules require an operator to inform each spaceflight participant in writing of the known hazards, the vehicle's safety record, and the absence of any federal certification, and to obtain written consent before any agreement to fly.
Aviation regulation begins with a certificate stating that a design meets a standard. Commercial human spaceflight has no such certificate, and the absence is not an oversight waiting to be corrected. Congress decided that a nascent industry should be allowed to learn from flying before design standards were written for it, and the regime that exists is built around disclosure to the people who accept the resulting risk.
Why there are no occupant safety rules
The statute permits the agency to issue regulations governing the design or operation of a launch vehicle to protect the health and safety of crew and spaceflight participants only in defined circumstances. Until those circumstances arise, the restraint holds, and Congress has extended it repeatedly rather than letting it lapse.
The circumstances that lift it are event-driven. A design feature or operating practice that has resulted in a serious or fatal injury, or in an event posing a high risk of one, opens the door to regulation addressed to that feature. So does a determination, grounded in accumulated flight experience, that a particular practice presents an unacceptable risk. The design is that rules follow demonstrated problems rather than anticipating them.
The restraint reaches only occupant safety. Everything protecting the uninvolved public applies in full: the collective and individual casualty criteria, the hazard areas, the flight safety systems and the analyses behind them, all as described in licensing a launch and a reentry. A crewed vehicle is regulated exactly as an uncrewed one is with respect to people on the ground.

The line between crew and participant matters because the duties differ. Crew must be qualified and trained for the role, and a member of the flight crew operating the vehicle must hold an ordinary pilot certificate with an instrument rating. Participants are not required to be qualified for anything; they are required to be informed, and to be trained in how to respond to emergencies including loss of cabin pressure, fire, smoke and emergency exit.
The content of informed consent
The operator must inform each spaceflight participant in writing about the risks of the launch and reentry, including the safety record of the vehicle type. It must identify each known hazard and risk that could result in serious injury, death, disability, or total or partial loss of physical or mental function. It must state that participating in spaceflight may result in death, serious injury or total or partial loss of physical or mental function.
The disclosure must also state plainly that the United States Government has not certified the launch vehicle as safe for carrying crew or spaceflight participants. That sentence carries the weight of the whole regime: it converts the absence of a certification standard from a hidden fact into a disclosed one.
The participant must be given an opportunity to ask questions and to receive answers, and must then give written consent, signed and dated, to participate in the launch and reentry. Timing is prescribed. The consent must be obtained before receiving any compensation and before entering into any agreement to fly, so a signature collected on the morning of the flight is a signature collected too late. The demand for consent that is both informed and confirmed in writing has a close analogue in professional practice, where consent confirmed in writing after full disclosure serves the same evidentiary purpose.
The federal rules require disclosure; they do not immunize the operator. Whatever protection exists against a negligence claim comes from state legislation and from contract, and those routes almost always preserve claims for gross negligence or intentional misconduct. Treating the consent form as a release is a misreading of what it is.
Security, life support and the flight itself
Beyond consent, the rules impose duties that look like the operational core of an airline. The operator must implement security measures to prevent anyone aboard from jeopardizing the safety of the flight, must screen for weapons and explosives, and must deny boarding to anyone who presents such a risk. It must provide an environmental control and life support system adequate to sustain life and consciousness for all occupants, must monitor and control cabin atmosphere, and must detect and suppress smoke and fire.
Verification is by the operator's own program rather than by a certification authority. The operator must verify the integrated performance of the vehicle's hardware and software in an operational flight environment before allowing anyone aboard who is not essential, and must train crew for the roles they will perform, including in a simulator where the training requires one.
Waivers, insurance and state statutes
The financial architecture is the same one that governs any licensed launch. The licensee carries third-party liability insurance sized by the regulator's maximum probable loss calculation, and the parties in the launch chain sign reciprocal waivers of claims against each other and against the government. Spaceflight participants were brought within that waiver structure by statute, which places them in the same position as customers and contractors rather than in the position of ordinary passengers.
Several states have added informed consent statutes of their own, barring suits arising from the inherent risks of spaceflight activities where a statutory warning has been given and signed, while preserving claims for gross negligence or willful misconduct. These operate on the tort claim itself rather than on the federal licensing obligations, so an operator complying fully with the federal rules may still face a claim, and an operator with a signed state-law warning may still owe damages if the injury came from something other than an inherent risk.
Behind all of it sits the treaty exposure of the launching state, examined in state liability for a satellite under treaty, and the broader question of which activities in orbit anyone actually authorizes, taken up in payload review and the gap in mission authorization. Carrying people is one of the few space activities the domestic system addresses squarely, and it does so by requiring honesty rather than by setting a standard.

Does signing a consent form bar a later lawsuit?

A pilot occupying a flight crew role is in a different position, since crew qualification requirements draw on ordinary aviation certification including medical standards.
Can an experimental permit be used to carry a customer?
No. An experimental permit authorizes development and test flights of a reusable suborbital rocket, and it expressly forbids carrying any person or property for compensation or hire. A vehicle flown under a permit can carry crew involved in the test program, but the moment anyone pays to be aboard, the operation requires a license. Operators therefore use permits to accumulate flight experience and then transition, which is one reason the permit and license processes are run in sequence rather than in parallel.
