The Foreign Affairs Manual is the Department of State's internal directives system, and its visa volume compiles statute, regulation and Departmental instruction in one place. It is interpretive guidance rather than a legislative rule: it was not adopted through notice and comment, it does not carry the force of law, and it creates no rights an applicant may assert. What it does create is an internal obligation that makes consular practice broadly uniform across posts.

The Sealed Visa Packet and the Inspection That Follows

An immigrant visa applicant leaves the consulate with the visa in the passport and, at many posts, a sealed envelope containing the case file. The envelope is for the inspecting officer and must not be opened by the traveler. At the port of entry the immigrant is an applicant for admission: the officer verifies identity, checks the visa, examines admissibility, endorses the passport, and takes the packet. Status begins at admission and not before.

Consular Notification When a National Is Arrested Abroad

Under the consular relations treaty, authorities detaining a foreign national must inform that person without delay of the right to have their consular post notified, must notify the post on request, and must forward communications. Consular officers may visit, converse, correspond and help arrange legal representation unless the detainee objects. Bilateral agreements make notification mandatory for some countries. The duty is reciprocal, and remedies for a breach are thin in domestic courts.

Section 222(g): When an Overstay Voids the Visa Itself

Section 222(g) of the Immigration and Nationality Act provides that a nonimmigrant visa held by a person who remains in the United States beyond the period of stay authorized by the Attorney General is void at the end of that period. The rule bites even where the visa carries years of remaining validity, and it carries a second consequence: any later nonimmigrant visa application must be filed in the country of the applicant's nationality unless extraordinary circumstances are found.

Withdrawing a Petition and What It Does to the Beneficiary

A petitioner may withdraw a petition at any time before a decision is issued, and the withdrawal cannot be revoked. After approval, a written withdrawal is a listed ground for automatic revocation, subject to a carve-out for employment-based petitions that have been approved for a sufficient period or whose associated adjustment applications have been pending long enough. The beneficiary has no standing to withdraw, to object, or to appeal, but may retain a priority date.

The Guam and Northern Marianas Visa Waiver

Section 212(l) of the Immigration and Nationality Act authorizes a visa waiver for admission to Guam and the Commonwealth of the Northern Mariana Islands. Nationals of designated countries and geographic areas may be admitted for business or pleasure for a period fixed by regulation, on an electronic travel authorization, without a visa. Admission is confined to the two territories, cannot be extended, and carries a waiver of most rights to contest removal.

Automatic Extension of a Work Permit on Timely Renewal

Where a renewal application is properly filed before the document expires, under the same eligibility category, and in a category the regulation makes eligible, employment authorization continues past the printed expiration date. The extension ends on the earlier of the end of the authorized period or notification of a denial. For verification, the expired document together with the receipt notice showing the matching category is what the employer records.

Social Media Identifiers on a Visa Application

Applicants for immigrant and nonimmigrant visas must list the usernames or handles they have used on specified social media platforms during a stated look-back period. The requirement is a disclosure of identifiers, not of passwords or private content. An incomplete answer can support refusal of the application as incomplete; a knowingly false answer can support a finding of willful misrepresentation of a material fact, which is a lifetime ground of inadmissibility with only narrow waivers.

How a Benefit Agency Verifies Immigration Status

Agencies administering restricted federal, state and local benefits must verify immigration status through a designated federal service rather than by reading documents themselves. Verification runs through an automated query, a manual review by a status verifier, and a paper stage comparing document copies against the record. The response reports status only: eligibility remains the agency's decision, and a mismatch is corrected through the immigration record rather than the benefit file.

Prior Refusals and the Record That Follows an Applicant

Consular regulations require every visa application to be either issued or refused, so a case held for further processing is recorded as a refusal even when it is later approved. Refusals are entered in a shared database available to all posts and to inspecting officers. Later applications ask about prior refusals, and an answer that treats an incomplete-application refusal as no refusal at all creates a far larger problem than the original outcome did.

Admission for Duration of Status and What It Leaves Open

Students, exchange visitors, foreign media representatives, and diplomatic and international organization personnel are ordinarily admitted for duration of status rather than until a fixed date. The admission lasts while the qualifying activity continues, plus any grace period the regulation allows. Because there is no expiration date, a violation is established by a finding rather than by the calendar, and that finding is made by the benefits agency or an immigration judge.

The DS-5535 and the Fifteen-Year Question Set

The supplemental questionnaire used by consular officers collects biographic detail beyond the standard application: travel, addresses, and employment across fifteen years, family names and dates of birth, and identifiers used online and by telephone across five years. It is issued at an officer's discretion after the application has been refused pending further processing. The refusal is a refusal for reporting purposes, and the case remains unresolved until the vetting behind it concludes.
